Terms of Service for Dive With Jimmy Ltd

Dive With Jimmy Ltd, trading at 82 College Street, Kempston, Bedfordshire, MK42 8LU, provides scuba diving training and related services.
By booking or participating in any activities with Dive With Jimmy Ltd, you acknowledge that you have read, understood, and agree to these terms of service.
1. Booking and Payment
- All bookings are subject to availability and confirmation by Dive With Jimmy Ltd.
- Full payment is required at the time of booking to secure your place on a course or activity.
- Prices are subject to change without notice. The price at the time of booking will be honoured.
2. Cancellations and Refunds
- Cancellations made more than 14 days before the agreed course start date will receive a full refund minus a 25% administrative fee.
- Cancellations made 7–14 days before the agreed course start date will receive a 50% refund.
- No refunds will be given for cancellations made less than 7 days before the agreed course start date.
- Dive With Jimmy Ltd reserves the right to cancel or reschedule courses due to insufficient enrolment or unforeseen circumstances. In such cases, a full refund or alternative date will be offered.
3. Force Majeure
- Dive With Jimmy Ltd shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to natural disasters, acts of government, civil unrest, or pandemics.
- In the event of a force majeure occurrence, Dive With Jimmy Ltd reserves the right to reschedule or cancel activities without liability.
4. Health and Safety
- Participants must complete a medical questionnaire before participating in any diving activities.
- Dive With Jimmy Ltd reserves the right to require a medical certificate from a physician for any participant.
- Participants must adhere to all safety instructions provided by instructors and staff.
- Dive With Jimmy Ltd reserves the right to exclude any participant from activities if they are deemed to be a risk to themselves or others.
5. Medical Declarations
- All divers must complete a Recreational Diver Medical Declaration Form annually.
- If you answer “yes” to any questions on the medical declaration form, you must consult a UK Diving Medical Committee (UKDMC) Medical Referee before diving.
- Divers must inform Dive With Jimmy Ltd of any changes in their medical condition between annual declarations.
- Dive With Jimmy Ltd reserves the right to require a medical examination by a UKDMC Medical Referee at the diver’s expense if there are concerns about fitness to dive.
6. Certification and Training
- Certification is contingent upon successful completion of all course requirements, including theory, pool, and open water sessions.
- Dive With Jimmy Ltd follows the standards set by BSAC and SSI for all courses and certifications.
- Participants who do not meet the required standards may be asked to complete additional training at their own expense. Course completion timelines are based on the agency standards and have been priced accordingly. Below is a table covering additional training costs:
Pool Recreational / Specialty – £60 per session
Technical / XR Specialty – £125 per day (up to 3 dives)
— £200 per day (up to 2 dives)
7. Liability and Insurance
- Dive With Jimmy Ltd carries appropriate insurance for all its activities. However, participants are encouraged to have their own personal diving insurance. UK diving is covered by the NHS, kit insurance is recommended.
- Dive With Jimmy Ltd is not liable for any loss, damage, or injury resulting from participation in our activities, except in cases of gross negligence.
8. Privacy and Data Protection
- Dive With Jimmy Ltd will collect and process personal data in accordance with UK data protection laws.
- Participant information will be used for the purposes of course administration, marketing and safety.
- Participants can opt out of any marketing emails at any time by responding to Dive With Jimmy Ltd and through the link at the end of all email correspondence.
9. Intellectual Property
- All materials provided during courses remain the property of Dive With Jimmy Ltd or the respective training agency.
- Reproduction or distribution of course materials without permission is prohibited.
10. Equipment Hire
- Participants are responsible for the care of any equipment provided by Dive With Jimmy Ltd.
- Any damage to equipment due to negligence will be charged to the participant.
- Equipment hire is subject to availability and must be booked in advance.
- Hired equipment must be returned in the same condition as received, normal wear and tear excepted.
- The renter is responsible for any loss or damage to hired equipment beyond normal wear and tear.
- Dive With Jimmy Ltd reserves the right to charge for cleaning, repair, or replacement of damaged or unreturned equipment.
- By hiring equipment, the renter must prove they have the necessary qualifications and experience to use it safely.
- Unless requested the breathing gas provided within hire cylinders will be 21% ∓ 1%, more commonly referred to as ‘Air’.
11. Personal Equipment
- Personal equipment used during courses must be in good working condition and serviced according to manufacturer recommendations.
12. Breathing Gas Fills
- Dive With Jimmy Ltd provides air and nitrox fills for appropriately qualified divers.
- All gas blends will be analysed and labelled with the maximum operating depth (MOD) before being issued to the diver.
- Divers are responsible for verifying the contents and MOD of their cylinders before use.
- Dive With Jimmy Ltd reserves the right to refuse gas fills if there are concerns about the cylinder’s condition or the diver’s qualifications.
- Custom gas blends (e.g. trimix) are available upon request and are subject to additional charges and specific qualification requirements.
- The most recent Air Quality Test will be presented upon request.
13. Equipment Servicing
- Dive With Jimmy Ltd offers equipment servicing for a range of scuba diving equipment.
- All servicing is carried out by qualified technicians in accordance with manufacturer specifications and industry standards.
- Equipment submitted for servicing must be clean and free from salt residue. A cleaning fee may be applied if equipment requires additional preparation.
- Dive With Jimmy Ltd will provide an estimate for any repairs or replacement parts needed. Customer approval is required before proceeding with repairs that exceed the standard service cost.
- While every effort is made to complete servicing in a timely manner, turnaround times may vary depending on workload and parts availability. Estimated completion times will be provided but are not guaranteed.
- Dive With Jimmy Ltd reserves the right to refuse service on equipment that is deemed beyond economical repair or unsafe for use.
- Customers are responsible for collecting their equipment once servicing is complete. Equipment left uncollected for more than 30 days after the notified completion date may incur storage fees. Any uncollected equipment after 60 days will become property of Dive With Jimmy Ltd and sold to offset the cost of servicing.
- Dive With Jimmy Ltd provides a warranty on servicing work for a period of 60 days from the date of service, covering defects in workmanship. This warranty does not cover normal wear and tear, misuse, or abuse of the equipment.
- By submitting equipment for servicing, customers agree to these terms and authorise Dive With Jimmy Ltd to carry out necessary work as per manufacturer guidelines.
- Dive With Jimmy Ltd is not responsible for any loss of diving opportunities or other consequential damages resulting from equipment being serviced.
14. Changes to These Terms
These terms and conditions are subject to change and without prior warning.
